1. What is Sitly?

Sitly is an online service, the aim of which is to bring together, via the Website and its mobile apps, private individuals who wish to organise temporary childcare for their child(ren) by other private individuals or professional persons with private individuals or professional persons who are prepared to offer childcare services to private individuals. Users can form an opinion about the characteristics and qualities of other Users based on their profiles.

Sitly is part of the besloten vennootschap (“Limited Company”) 2Care4Kids Group B.V., also trading under the name Sitly, registered address (1012KV) Amsterdam, Rokin 44-C, and registered with the Chamber of Commerce of Amsterdam under registration number 56028458. The manner in which we store and use your personal details is registered with the College Bescherming Persoonsgegevens (“Board for the Protection of Personal Details”) under registration number m1517431.

2. Key Terms

Account refers to a set of resources and rights within a given computer system assigned to you as the User for the purpose of accessing and/or using the Platform.

Controller refers to an entity (in this case Sitly) that determines the purposes and means of the processing of the Personal Data.

Data Subject refers to any person whose personal data is being collected, held, or processed.

GDPR refers to the Regulation 2016/679 of The European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

Personal Data refers to all data mentioned in the section Profile.

Processing refers to the collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction of personal data.

Processor refers to an entity (in this case Sitly) that processes the Personal Data on behalf of the Controller.

User refers to a person acting as a parent, a babysitter, or a nanny who accesses and uses the Platform via the User’s Account.

User Content refers to any content and information posted, uploaded, published, linked to, transmitted, recorded, displayed, or otherwise made available on the Platform and/or transmitted by a User to other Users, including text messages, chats, videos, photographs, and others, whether it is publicly or privately transmitted.

3. Data Controller

Sitly is the controller responsible for the processing of personal data. For all questions concerning the protection of personal data, you can contact us through our contact form on our website.

Sitly has appointed a Data Protection Officer (DPO). You can contact our DPO directly at dpo@sitly.com, or through our contact form, with any questions about how Sitly processes your personal data.

4. What information is collected and processed by Sitly?


Profile

To contact other users, you must first create a personal profile. When you create such a profile, you will be asked to enter certain information about yourself. You are not obliged to enter all details.

You can alter the information that you provide at any time. You can also add other information to your profile, such as a photo or a link to your website.

Your profile is, in principle, public. This means anyone can view it. You can also set up your profile so that it is only visible to Users who also have a profile. You can change this setting at any time.

Content

Sitly stores and processes all Content that you make available via Sitly. If you publish content, for example, your profile, other users can use or react to it.

If you terminate your profile, then Sitly will immediately make your profile inaccessible. After termination, Sitly will store your data for up to six (6) months. Sitly will remove or anonymise the content, should you request this.

Automatically Generated Information

In order to ensure the effective operation of Sitly (for example, to ensure that pages are correctly displayed, and in order to ensure the security of the Service), Sitly requires certain information. Therefore, Sitly will automatically collect information about your browsing behavior while you use Sitly. This information consists of your IP address (the number of your computer on the Internet, which makes it possible to recognize your computer), the type of browser (computer program that facilitates the display of web pages), the computer system that you use, and the pages that you visit on the Website.

ID Verification and Background Check Data

When you choose to verify your identity, we process a photo of your government-issued ID and a live selfie. We use these to check that the selfie is of a real person and that it matches the photo on your document.

During this process, limited information from your document is briefly extracted to run these checks. We use it to generate a pseudonymous document identifier: an internal code created by Sitly that can’t be turned back into your name, date of birth, or any other readable detail. It is not a number taken from your document itself.

We don’t keep the document image, selfie, or extracted information in readable form once verification is complete. If you abandon a verification attempt, the images are automatically deleted within an hour.

We do keep the verification outcome, the date the verification was done by Sitly, and the pseudonymous document identifier for as long as your account is active, so we can spot if the same document is used to open another account. Even though the identifier can’t be read back to reveal your details, it can show us that a document has been reused, so we treat and protect it as personal data. We delete the pseudonymous document identifier when your account is deleted.

If you’re ID verified, this is shown as a badge on your profile. If you self-declare that you have a background check available, we keep a record of this and the date you last updated it too; this also appears on your profile, always labelled as self-reported. We don’t request, receive, verify, or store the certificate itself.

5. For what purpose does Sitly use information about me?

Purposes

Sitly will use information about you for the following purposes:

Sitly will keep you informed about the development of the Service. If there is, for example, a new extension to the Service or if an update is to take place, then Sitly will inform you about this. Sitly may also keep you informed about current or future special offers.

Should you not wish to receive email messages from Sitly, you can unsubscribe via the settings on your profile. A link that allows you to unsubscribe is also included in every email sent to you by Sitly.

Sitly uses automatically generated data for statistical purposes and to protect and improve Sitly. This data may be provided to third parties, provided that it is completely anonymised and thus not traceable to you personally (no personal details).

Use by Third Parties

Sitly may provide your details, including automatically generated information such as your IP address, to third parties where this is necessary to operate, secure, or provide the Service, for example to our payment service provider to process a payment you have requested, to our hosting and logging providers to run and secure the Service, or to identity verification and document-analysis providers to carry out ID Verification on our instructions. In other cases, Sitly may provide your details to third parties only where you have given your explicit permission for this, or if these details cannot be traced back to you personally.

Finally, Sitly may provide your details to third parties if obliged to do so by law or regulation, if required by a court case, or if we believe that it is necessary to do so in order to protect the rights of Sitly.

Sitly will not provide your details to third parties for direct marketing purposes (for example, for the sending of special offers) without your explicit permission. We will only do this with your explicit permission, which you can give or withdraw at any time in your account settings.

The Website may contain hyperlinks that, when clicked, will take you off the Sitly Website to another party’s website. Sitly has no influence over the services and/or websites that are linked to from the Sitly Website. It may therefore be that another privacy statement applies to these services and/or websites. The Sitly Privacy Statement only applies to (personal) details obtained via the Service. Sitly accepts no responsibility whatsoever for (the functioning of and/or content of) services and/or websites of third parties.

6. Legal basis of processing

The processing of your personal data is based on the following legal basis:

Consent
Sitly processes personal data based on the consent of our data subjects for one or more specific purposes.

Contractual Relationship
We process personal data you voluntarily provide for contractual processing, such as required payments.

Legitimate Interest
We process personal data given by the data subject because this is necessary for the purposes of the legitimate interests pursued by Sitly.

ID Verification
When you start ID Verification, we ask for your explicit consent to process your identity document and a selfie, and to compare the two to confirm they show the same person.

Background Check Declaration
If you choose to self-declare a background check declaration on your profile, adding it means you consent to us displaying it there.

Duplicate-document detection
We process a one-way hash generated from your identity document, which cannot be reversed to reveal your name, date of birth, or any other readable detail, based on our legitimate interest in preventing identity theft, fraud, and duplicate or fake profiles. A member of our team always reviews a possible match before taking any action on an account.

7. How does Sitly protect your personal information?

Sitly will apply appropriate technical and organizational measures in order to protect your (personal) details against loss and against any form of illegal processing. Among other measures, Sitly will ensure that all personal details are securely stored. Sitly uses enterprise-grade cloud providers for this data storage. Sitly keeps the pseudonymous document identifier generated from your identity document separately, and access to it is restricted to authorised staff. When third-party providers carry out ID verification at our instruction, your document photo and selfie are processed over an encrypted connection.

8. Rights of Data Subjects

You can request, view, and, if necessary, alter your (personal) details in your profile at any time. If you wish to know which details Sitly has stored about you, or if you wish to alter details that do not appear in your profile, then you may make contact with us through our contact form on the Sitly website.

You have the right to object to the processing of personal data concerning you, on grounds relating to your particular situation, when the processing of this data is based on our legitimate interests.

You can obtain from Sitly a restriction of processing in case the accuracy of the personal data is contested, in case the processing is unlawful, in case Sitly no longer needs the personal data for the purposes of the processing, but the personal data is required by you for the establishment, exercise, or defense of legal claims and, finally, in case you object to processing (as mentioned in the above paragraph).

You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit it to another controller.

You have the right to request the erasure of your personal data without undue delay in case your data is no longer necessary in relation to the purposes for which it was collected or otherwise processed, in case you withdraw your consent on which our processing is based, in case you have objected to our processing of your data and there are no overriding legitimate grounds for the processing, in case your data has been unlawfully processed, in case the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which Sitly is subject.

If your ID Verification cannot be completed because the photo of your document or your selfie cannot be read clearly, you can retry the check or contact our support team for help. If your Verification result raises a concern, for example because your selfie does not appear to match your document, or because your document appears to have already been used on another account, we may review this internally. We will not remove your Verified Badge, restrict it, or take any other action on your account without a member of our team reviewing the case first.

9. Transfer of data to countries outside the EU

For technical or operational reasons, it may be necessary to transfer your details to companies and/or service providers that support Sitly, including ones in the United States or other countries outside the European Economic Area (EEA). Where we do this, we rely on safeguards recognised under GDPR, such as an adequacy decision by the European Commission, the European Commission’s Standard Contractual Clauses, or, where applicable, the EU-US Data Privacy Framework. 10. May minors make use of Sitly?

This Privacy Statement may be amended. Such changes will be announced on the Website and/or in a message to you.
